Licence for the commercial renting out of civil aircraft - Application

General information

Pursuant to section 116 (1) Aviation Act (Luftfahrtgesetz, LFG) the commercial renting out of civil aircraft requires licensing by the Governor of the Province.

Required documents

The following documents must be submitted along with the application for a licence:
  • Type, manufacturer, serial number, year of manufacture, markings of the aircraft to be rented out, entry in aircraft register
  • Austro Control GmbH certificate of registration (German)
  • Business address of the aircraft rental business, details on the person responsible for rental operations
  • Applicants’ citizenship certificate or valid pilot licence (commercial pilot licence or commercial helicopter pilot licence)
  • Certificate of airworthiness
  • Aircraft qualification certificate (periodic inspection certificate)
  • If the application is submitted by a legal entity: Excerpt from the company register (German) signed by the natural persons authorised to represent the entity
  • Police clearance certificate (German) (may be replaced with a valid pilot licence)
  • Commercial pilot licence of the person responsible for rental operations or any other suitable proof of professional competence
  • Where power of attorney was granted: Submission of power of attorney

Deadlines

The completion of the procedure depends on the individual initial situation in each case. An incomplete submission of documents delays the procedure.

Costs and fees

The following costs are payable after completion of the administrative procedure:
  • EUR 380 in federal administrative charges (for each civil aircraft)
  • EUR 47,30 in charges pursuant to the Fees and Duties Act for submission of the application
  • Further fees and charges for enclosures
  • EUR 83,60 for issuing the original ruling

Requirements

The licence will be granted if the following requirements as set out in section 117 (1) Aviation Act are met:
  • The applicants are nationals of a Contracting State of the Agreement on the European Economic Area, are reliable, have the required technical qualifications, and own or exercise control over the aircraft to be rented out.
  • Safe operation must be ensured, and there must be demand for such service.
  • The civil aircraft intended for renting out must have Austrian nationality, i.e. be registered in Austria.

With this procedure, the decision of the public authority will be served electronically. If the applicant is not registered with any electronic delivery service (German), the decision will be sent by post.

More information

In the interest of traffic safety, the granting of a licence for renting out aircraft pursuant to section 117 (2) Aviation Act is subject to certain conditions being met. If the requirements for granting the licence no longer apply or if operations have ceased for more than one year, the licence will be revoked.

Section 117 (1) (b) Aviation Act provides that, before a licence is granted, the Economic Chamber under the geographical purview of which the aircraft rental business is to be operated must be given an opportunity to comment.

Authentication and signature

Authentication or signature of the application is not required.

Means of redress or appeal

An appeal is possible against rulings issued by an authority and shall be filed by the party within a four weeks term with the authority that issued the ruling of first instance (against rulings without investigation procedure within a two weeks term). The term starts with the receipt of the written copy of the ruling, in the case of oral pronouncement simultaneously with it.

The appeal shall indicate the ruling it contests, the authority that issued the ruling and contain a motion of appeal with the reasons. No more appeal is admissible if the party expressly waived the right of appeal after receipt or pronouncement of the ruling.

Each ruling contains instructions on the right to appeal and indicates the authority and the deadline for submission of such appeal.
