Daily structure and assisted living for persons with disabilities - notification of start of operations, changes, or closure

General information

Persons with disabilities under the Vienna Equal Opportunities Act are individuals who are permanently and significantly disadvantaged in their development or in important areas of life, particularly vocational training, work, or social participation, due to not age-related physical, intellectual or mental impairments, or sensory impairments.

The provision of daily structure is defined as services for persons with disabilities who currently or permanently cannot be integrated into the labour market.

Assisted living is defined as living in a facility with board and care.

Operators of such a facility must notify the authority of the following changes:
  • Expansion or considerable reduction of the services, closure of the facility
  • Changes to the services offered
  • Transfer of the facility to another operator
  • Change of name of the operator(s) or the facility
  • Moving the facility to another location
  • Changes in management

Required documents

  • Details on the operators and any persons acting on their behalf (e.g., excerpt from the register of associations (German), excerpt from the company register (German), partnership agreement, etc.)
  • Details on the trustworthiness of the operators and the persons acting on behalf of the facility (police clearance certificate no older than 3 months of the managing director, board of directors, or managing secretary) (German)
  • Description of the facility and services, including the care plan (target group, maximum number of clients, description of planned measures such as support and care)
  • House rules for the internal operation, i.e. general rules for living together.
  • Staff plan including, in particular, a professionally suited and qualified individual as head of the facility, sufficient and adequately trained staff who are suitable for work with the target group and the planned services and care.
  • Floor plan and description of the facilities and their functions.
  • Documentation showing that a fire prevention officer has been appointed.
  • If there are any changes (expansion, changes in the range of services offered, etc.), all documentation necessary for the evaluation of the planned measure must be presented.
  • Should the facility be closed, a written statement must be provided that describes how the clients will be cared for in the future.

Deadlines

Operators of a facility that provides daily structure or assisted living must notify the Vienna City Administration no later than three months before the start of operations and include the documents listed below.

Notification of the following measures must be made in writing four weeks before the planned measure:
  • Expansion
  • Considerable reduction of services
  • Changes in the range of services
  • Closure of the facility
  • Transferring the facility to another operator
  • Change of name of the operator(s) or the facility
  • Moving the facility to another location
  • Changes in management

Procedure

  • The authority will review the notification and the submitted documents and decide whether the operation of the facility is admissible or will be prohibited.
  • The operation of the facility is permitted if the authority does not prohibit the start of operations within three months of receipt of the notification and all necessary documents.
  • The operation of such a facility will be prohibited if the notification and the documents provided do not provide sufficient evidence to ensure that the professional provision of the service can be guaranteed.

Requirements

Operators of such a facility must ensure that the facilities, management and organisation are suitable for the provision of adequate and professional services for persons with disabilities.

Authentication and signature

Authentication or signature of the application is not required.

Means of redress or appeal

An appeal is possible against rulings issued by an authority and shall be filed by the party within a four weeks term with the authority that issued the ruling of first instance (against rulings without investigation procedure within a two weeks term). The term starts with the receipt of the written copy of the ruling, in the case of oral pronouncement simultaneously with it.

The appeal shall indicate the ruling it contests, the authority that issued the ruling and contain a motion of appeal with the reasons. No more appeal is admissible if the party expressly waived the right of appeal after receipt or pronouncement of the ruling.

Each ruling contains instructions on the right to appeal and indicates the authority and the deadline for submission of such appeal.
